Terms of Service
The terms that follow exist to maintain the integrity of all services provided by Angry Paw Productions. By ordering or hosting a website from Angry Paw Productions, you are agreeing to each of the terms listed below:
This Agreement, is made and entered by Angry Paw Productions, herein referred to as ("Provider"), and you, referred to in this document as ("User").
A. INDEMNIFICATION AND RELATIONSHIP OF PARTIES
1. User agrees to indemnify and hold Provider harmless from any lawsuit, claim, charge, or expense, including reasonable attorney fees and costs of defense, for any matter arising from or relating to User's website provided hereunder.
2. Nothing contained herein shall be deemed to create a relationship between the Provider and User in the nature of a partnership, joint venture, editor/publisher or otherwise. Both parties acknowledge and agree that Provider has no interaction with the data or substance of User's website, except as necessary to maintain the website.
3. User agrees that it shall defend, indemnify, save and hold Angry Paw Productions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Angry Paw Productions, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. User agrees to defend, indemnify and hold harmless Angry Paw Productions against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Angry Paw Productions; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Angry Paw Productions' server.
B. PAYMENT FOR SERVICE
1. User agrees to pay the charges agreed to at the time of arranging services from the Provider. Renewals of services including but not limited to domain registrations, website hosting, and website administration packages will be paid in full on or before the anniversary of account setup annually following execution of this agreement, together with any additional charges, costs or assessments made by Provider under the terms hereof.
2. User agrees payment not recieved within 7 days of said renewal date shall be considered late and service may be suspended.
3. User agrees payment not received within 14 days of said renewal date shall be considered in default and service shall be terminated.
4. User agrees that any and all unpaid balance due hereunder shall bear interest at the rate of 18% per annum, and that costs of collection, including court costs and reasonable attorney fees shall be added as principal amounts to such balance.
5. User agrees to pay a $30 processing fee for any returned checks, for whatever reason, and agrees they may be electronically reprocessed.
C. REFUSAL OF SERVICE
Angry Paw Productions reserves the right to refuse or cancel service at its sole discretion. Failure to follow any terms or conditions established by Angry Paw Productions may result in immediate termination.
D.CONTENT
The User agrees to indemnify and hold harmless Angry Paw Productions from any claims resulting from the use of our services.
1. COPYRIGHTS: Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, images or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting.
2. The User is solely responsible for applying coprights to any data including but not limited to images, music, artwork, and logos which are the property of The User.
3. User is solely responsible for any content they place on their web site, or transfer by any other means using hardware and or bandwidth belonging to the Provider.
4. The User is allocated a monthly bandwidth allowance. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, or to terminate the account. Unused transfer in one month cannot be carried over to the next month
5. The Provider reserves the right to remove any page(s) at any time without notice.
E. UNSOLISITED ELECTRONIC MAIL (SPAM)
1. User is expressly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. Such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. We reserve the right to immediately deactivate your use of our service if we discover such activity. Further, you agree to indemnify and hold Angry Paw Productions harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement.
2. ZERO TOLERANCE SPAM POLICY: The Provider takes a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
F. USE OF SERVICE
1. User agrees to maintain its site in a manner consistent with any and all applicable laws, regulations, acceptable uses and standards in effect, or which become in effect, during the term hereof.
2. User agrees to practice common courtesy in its use of the site, and to refrain from using any distribution lists for electronic mail or other techniques for unsolicited mass mailing.
3. User agrees to keep their contact information with Provider current at all times, and agrees Provider has no liability for lost or undelivered mail or email messages concerning the status or payment due for User's account.
4. User agrees to comply with the wishes of the Provider in regards to practices that may hinder the ability of other Angry Paw Productions customers to use the Provider's services.
G. SECURITY
1. User agrees not to attempt to undermine or cause harm to any server or customer of Provider. Failure to comply with this rule will result in immediate termination of the user's account.
2. Porvider is not responsible for any loss of data resulting from malicious software, computer viruses, spyware, and or any other type of cyber attack which occurs on hardware belinging to the User.
H. DISCLAIMER
Angry Paw Productions shall not be responsible for any damages your business may suffer. Angry Paw Productions makes no warranties of any kind, expressed or implied for services we provide. Angry Paw Productions disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Angry Paw Productions and its employees.
I. DISCLOSUE TO LAW ENFORCEMENT
Angry Paw Productions may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
J. CHANGES TO TERMS OF SERVICE Angry Paw Productions reserves the right to revise its policies at any time without notice.
